By accessing, registering for, or using the GunStreamer platform ("Platform"), you ("User," "You," or "Your") agree to be bound by these Terms of Service ("Terms"), our [Privacy Policy], our [Community Guidelines], and all applicable laws and regulations. IF YOU DO NOT AGREE TO ALL TERMS, DO NOT USE THIS PLATFORM.

These Terms constitute a legally binding agreement between you and us. We may update these Terms from time to time in our sole discretion. If we do, we'll post the updated Terms on the Platform and may send other communications. It's important that you review these Terms whenever we update them or you use the Platform. If you continue to use the Platform after we have posted updated Terms, it means you accept and agree to the changes.

GunStreamer is operated by Secure Shield Corporation ("Company," "We," "Us," or "Our"), a Texas corporation. GunStreamer operates exclusively as an interactive computer service under 47 U.S.C. § 230 that provides a technology platform enabling:

Core Platform Functions:

● Licensed Federal Firearms License holders ("FFLs" or "Dealers") to create, upload, and broadcast third-party livestream content and auction listings

● Users to view dealer-generated content and participate in dealer-conducted live auctions

● Communication facilitation between buyers, dealers, and hosts

● Content hosting and distribution services for third-party content providers

● Technology infrastructure for secure video streaming and real-time bidding

● Payment processing coordination through third-party processors (Fortis)

● Identity verification services through third-party KYC providers

Multi-Party Transaction Model:

● Dealers: Licensed FFLs who list inventory and conduct livestream auctions from their licensed premises

● Buyers: Verified users who bid on and purchase firearms through mandatory FFL transfers

● Hosts: Content creators and influencers who may livestream on-site at dealer premises (off-site hosting requires additional licensing not part of current platform)

● Platform: Technology intermediary facilitating communications, payments, and compliance monitoring

Third-Party Service Integration:

● Payment processing through Fortis (backup) with integrated fraud detection

● Identity verification through Jumio, Alloy, or ID.me with facial recognition and document scanning

● Shipping coordination through FedEx (preferred) and UPS for FFL-to-FFL transfers

● Compliance verification through ATF eZCheck and automated blocking systems

● Content moderation through Hive or Spectrum Labs for livestream safety monitoring

● Infrastructure hosting through AWS and Cloudflare for secure, scalable operations

● Sell, transfer, ship, or handle firearms at any time

● Act as a firearms dealer, broker, or intermediary in any transaction

● Take possession, custody, or control of firearms

● Conduct background checks, complete ATF Form 4473, or facilitate transfers

● Guarantee any transaction completion, dealer performance, or product authenticity

● Create, edit, or control the substance of third-party content beyond platform safety policies

● Act as publisher or speaker of any information provided by dealers, hosts, or users

● Make representations about firearm legality, suitability, or compliance in any jurisdiction

You represent and warrant that you:

● Are at least 21 years of age

● Are legally eligible to purchase firearms under federal, state, and local law

● Are not prohibited from possessing firearms under 18 U.S.C. § 922 or any other applicable law

● Will comply with all applicable firearms laws in your jurisdiction

● Government-issued photo identification verification through third-party KYC providers (Jumio, Alloy, or ID.me)

● Facial recognition and biometric matching to government ID

● Address verification through utility bills, bank statements, or other official documents

● Social Security Number verification where legally required

● Payment method verification ensuring cardholder name matches verified identity

● Additional enhanced verification for high-value transactions or suspicious activity

● Registration name must match government-issued ID exactly

● Payment method cardholder name must match verified account holder

● FFL pickup must be conducted by verified account holder with matching ID

● Any mismatch between registration, payment, and pickup identities will result in immediate account suspension

● Unverified accounts cannot participate in auctions, make purchases, or access platform features

● Failed verification attempts are logged and may trigger permanent platform ban

● False information provided during verification constitutes breach of contract and potential criminal activity

● We reserve the right to re-verify identity at any time, including before high-value transactions

● Accounts may be automatically suspended based on algorithmic fraud detection or risk scoring

The following users are PERMANENTLY BANNED:

● Individuals prohibited from possessing firearms under federal, state, or local law

● Individuals attempting to make straw purchases or acting as straw purchasers

● Users providing false identification or verification information during KYC process

● Individuals under federal indictment for crimes punishable by imprisonment exceeding one year

● Users subject to domestic violence restraining orders or protective orders

● Anyone acting on behalf of prohibited persons

● Individuals on terrorist watchlists or subject to OFAC sanctions

● Users engaged in money laundering or other financial crimes

Accounts may be automatically terminated based on background check results, verification failures, or algorithmic detection of prohibited conduct without prior notice.

You may use GunStreamer solely for:

● Viewing dealer-generated livestream content

● Participating in dealer-conducted auctions as an eligible purchaser

● Communicating with licensed dealers regarding legal firearm transactions

● Straw purchases or purchases on behalf of prohibited persons (FEDERAL FELONY)

● Attempting to circumvent background check requirements

● Providing false information to dealers or the platform

● Attempting to complete transactions outside the FFL transfer system

● Harassment, threats, or inappropriate conduct toward other users

● Posting prohibited content or attempting to sell prohibited items

● Using the platform for any illegal activity

FEDERAL CRIMINAL WARNING Purchasing a firearm for another person who cannot legally purchase or possess firearms is a FEDERAL FELONY punishable by up to 10 years in prison and $250,000 in fines. Making false statements on federal forms is a separate felony. GunStreamer actively monitors for straw purchases and reports suspected violations to federal authorities.

All dealers on GunStreamer are independent contractors with valid Federal Firearms Licenses verified through ATF eZCheck and manual vetting processes. GunStreamer has no control over:

● Dealer business practices, pricing, inventory selection, or auction conduct

● Transaction completion, cancellation, or modification

● Shipping methods, timing, packaging, or costs

● Background check processing, results, or FFL transfer procedures

● Firearm condition, authenticity, legality, or suitability

● Compliance with federal, state, or local firearms regulations

● Complete identity verification through third-party KYC providers before bidding

● Select destination FFL dealer before placing any bids

● Provide accurate information for shipping and transfer purposes

● Complete ATF Form 4473 and NICS background check at chosen FFL

● Pay all applicable taxes, transfer fees, shipping costs, and FFL charges

● Comply with all federal, state, and local firearms laws

● Pickup firearm only after successful background check completion

● Ensure legal eligibility to possess firearms in jurisdiction of pickup

● Maintain valid FFL throughout all transactions and provide proof upon request

● Verify inventory and serial numbers before listing items for auction

● Conduct all required background checks and ATF compliance procedures

● Ship firearms only to licensed FFLs selected by buyers

● Maintain required federal record-keeping per ATF regulations

● Comply with all applicable firearms laws and dealer agreement obligations

● Package and ship items securely with appropriate carrier requirements

● Provide tracking information and delivery confirmation to buyers

● Provide secure technology infrastructure for livestreaming and bidding

● Process identity verification through third-party KYC providers

● Coordinate payment processing through or Fortis (backup)

● Apply automated compliance controls and state/local restriction blocking

● Monitor for prohibited conduct and report violations to authorities

● Maintain audit trails of all transactions, bids, and transfers

● Remove violating content or users when identified through monitoring

● Dealer creates livestream auction listing with verified inventory

● Buyer places legally binding bid after selecting destination FFL

● Platform processes payment through third-party processors with fraud checks

● Dealer ships firearm to buyer's chosen FFL using approved carriers (FedEx/UPS)

● Buyer completes background check and Form 4473 at destination FFL

● FFL transfers firearm to buyer only upon successful background check

● Platform releases payment to dealer minus applicable fees

● Completion of any transaction or auction

● Dealer performance, reliability, or inventory accuracy

● Firearm condition, authenticity, legality, or description accuracy

● Background check approval or processing timing

● Shipping or transfer timing, costs, or successful delivery

● Resolution of disputes between buyers, dealers, or FFLs

● Compliance with any applicable laws or regulations

Payment Processors: Payments are processed through our designated third-party payment processors:

● Fortis payment processing for redundancy and reliability

● All payments subject to Address Verification Service (AVS) and fraud screening

● Additional identity verification may be required for high-value transactions

Payment Methods: Authorized payment methods include credit cards and debit cards issued by major financial institutions. Payment method must be issued to and owned by the verified account holder. We reserve the right to restrict or decline certain payment methods based on risk assessment.

● Payment method cardholder name must exactly match verified account holder

● Billing address must match verified account address or provide acceptable explanation

● Credit/debit cards must be issued to verified account holder (no third-party cards)

● Bank account ownership verification required for ACH transactions

● Enhanced verification required for international payment methods

● Velocity checks for unusual bidding or payment patterns

● Device fingerprinting and behavioral analysis

● Automatic holds on suspicious transactions pending manual review

● Cooperation with payment processor fraud prevention systems

● Platform earns commission per completed transaction (paid by dealer)

● Commission rates disclosed in dealer agreement and may vary by transaction volume

● Optional fees for promotional services, host bonuses, and premium features

● Credit card processing surcharges may apply based on payment method

● All fees clearly disclosed before transaction completion

● Buyers responsible for shipping costs, FFL transfer fees, and applicable taxes

● Dealers responsible for platform commission and optional service fees

● No hidden fees or undisclosed charges

● All payment data encrypted and processed through PCI-compliant systems

● Platform does not store complete credit card numbers or sensitive payment data

● Payment tokenization used to protect stored payment methods

● Regular security audits and penetration testing conducted

● Complete audit trail maintained for all financial transactions

● Records available to users through secure account dashboard

● Transaction history preserved for tax reporting and compliance purposes

● Data retention policies comply with financial regulations and legal requirements

Content Creation and Ownership: All livestream content, auction listings, product descriptions, images, videos, and other materials posted by dealers and users constitute third-party content created by information content providers other than GunStreamer. GunStreamer does not create, edit, or control the substance of any third-party content.

No Editorial Control Over Content Substance: While GunStreamer reserves the right to remove content that violates our Terms or applicable law, we do not exercise editorial control over the substance, viewpoint, or message of dealer-generated content. Content moderation decisions are made based on neutral, content-agnostic policies focused on legal compliance and platform safety.

Interactive Computer Service Functions: GunStreamer operates as an interactive computer service that:

● Provides technical infrastructure for third-party content hosting and distribution

● Enables communication between content creators (dealers) and viewers (buyers)

● Offers tools for content organization and discovery

● Maintains platform integrity through automated and human content review

● Dealers retain ownership of their livestream content and auction materials

● Users grant platform limited, non-exclusive license to host, transmit, and display content solely for platform operation

● Platform may remove violating content immediately in accordance with Community Guidelines

● Users responsible for ensuring all content complies with applicable laws and these Terms

Platform employs third-party content moderation services (Hive, Spectrum Labs) to automatically detect and filter:

● Unsafe or illegal livestream content

● Prohibited firearm types or modifications

● Inappropriate language or behavior during auctions

● Potential safety violations or dangerous conduct

● Suspicious activity patterns indicating fraud or violations

● All content moderation decisions based on objective, neutral criteria focused on legal compliance and platform safety

● No editorial control exercised over dealer opinions, pricing strategies, or business practices

● Moderation limited to removing clearly illegal content or enforcing platform safety policies

● Appeals process available for content removal decisions

● Dealers and hosts solely responsible for content of their livestreams

● Platform provides technology infrastructure only, not content creation or editorial services

● Real-time monitoring for safety compliance, not content editorial control

● Users acknowledge livestream content represents views and opinions of dealers/hosts, not platform

● Personal information collected per our Privacy Policy

● Verification data retained as required by law and business needs

● Information may be shared with law enforcement when legally required

● Transaction data may be shared with participating dealers

We will disclose user information to government authorities:

● When required by valid legal process

● To investigate suspected criminal activity

● To comply with firearms regulations

● As otherwise required by law

Interactive Computer Service Status: GunStreamer operates as an interactive computer service under 47 U.S.C. § 230. We provide access to information content provided by third parties and enable computer services to host, display, and distribute such content. We are not liable for any content created by third-party information content providers (dealers, users, or other content creators) on our platform.

No Publisher Liability: GunStreamer shall not be treated as the publisher or speaker of any information provided by dealers, users, or other third-party content providers. This includes but is not limited to:

● Auction listings and product descriptions

● Livestream content and commentary

● User communications and reviews

● Pricing information and availability

● Product recommendations or endorsements

Content Responsibility: All content-related claims should be directed against the actual content creator (dealer or user), not against GunStreamer as the hosting platform.

● Implied warranties of merchantability or fitness for particular purpose

● Warranties regarding system availability, security, or accuracy

● Warranties regarding third-party (dealer) performance or content accuracy

● Warranties regarding transaction completion or legal compliance

● Warranties regarding content authenticity, quality, or suitability

We do not guarantee that the Platform will be error-free, uninterrupted, or free from security vulnerabilities. Users acknowledge that internet-based services inherently involve technical risks.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

● Platform liability limited to fees paid by user in preceding 12 months (or $100 if no fees paid)

● No liability for indirect, consequential, punitive, special, or incidental damages

● No liability for dealer actions, omissions, performance, or content

● No liability for transaction disputes, fraud, or legal violations by users

● No liability for third-party content accuracy, authenticity, or completeness

● No liability for platform downtime, data loss, or security breaches beyond our reasonable control

Platform bears no responsibility for actions taken by dealers, buyers, payment processors, shipping companies, or other third parties. All such relationships are solely between users and those third parties.

You agree to indemnify, defend, and hold harmless Secure Shield Corporation, its officers, directors, employees, agents, affiliates, and any third-party service providers from any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorney fees) arising from or related to:

● Your use of the platform or participation in any transaction

● Your violation of these Terms, applicable laws, or third-party rights

● Your content, communications, or representations on the platform

● Your failure to comply with verification, KYC, or identity requirements

● Any false, misleading, or inaccurate information you provide

● Your transactions with dealers or other users

● Your violation of any intellectual property or proprietary rights

● Any breach of your representations and warranties

Additional indemnification required for:

● Straw purchase attempts, violations, or related criminal activity

● Identity fraud, verification violations, or false documentation

● Federal, state, or local firearms law violations

● Attempts to circumvent background check requirements

● Engaging in prohibited firearm transactions

● Money laundering, terrorist financing, or sanctions violations

● Any criminal activity conducted using the platform

You further agree to indemnify us against any claims brought by:

● Government agencies investigating firearms violations

● Law enforcement conducting criminal investigations

● Regulatory bodies enforcing compliance requirements

● Other users claiming fraud, misrepresentation, or platform violations

● Payment processors claiming chargebacks or fraudulent transactions

● Intellectual property owners claiming infringement

You agree to cooperate fully in the defense of any claims and acknowledge that we may, in our sole discretion, control the defense and settlement of any claim subject to indemnification. You may not settle any claim without our prior written consent.

We may terminate or suspend accounts immediately for:

● Violation of these Terms

● Suspected criminal activity

● Failure to complete verification

● Providing false information

● Engaging in prohibited conduct

● Legal compliance requirements

● Loss of access to platform and services

● Forfeiture of account benefits and privileges

● Continued obligation for outstanding fees

● Survival of indemnification and liability limitations

● Automated blocking of prohibited items per ATF regulations (full-auto firearms, unlicensed suppressors, destructive devices)

● State-by-state restriction enforcement including assault weapon bans and magazine capacity limits

● FOID (Firearm Owner's Identification) requirement checking for Illinois and other applicable states

● Local municipality restriction screening and automatic transaction blocking

● Real-time FFL license verification through ATF eZCheck integration with manual vetting backup

● Real-time updates based on changing federal, state, and local firearms laws

● Automated user eligibility screening based on shipping destinations and pickup locations

● Integration with OFAC sanctions lists and prohibited persons databases

● Geographic restriction enforcement preventing sales to prohibited jurisdictions

● Age verification for different firearm types (handguns vs. long guns)

● Machine learning algorithms detect suspicious bidding patterns and potential straw purchases

● Behavioral analysis monitoring for unusual account activity or rapid successive purchases

● Cross-reference verification between registration data, payment methods, and pickup locations

● Velocity checks preventing rapid-fire transactions that may indicate trafficking

● Integration with third-party fraud detection services for enhanced screening

● Comprehensive logging of all compliance checks, automated decisions, and manual reviews

These Terms governed by Texas state law without regard to conflict of law principles. Exclusive jurisdiction and venue: State and federal courts located in Dallas County, Texas.

Mandatory Arbitration Process:

● Disputes subject to binding arbitration per rules of American Arbitration Association

● Class action lawsuits and jury trials waived by all parties

● Arbitration location: Dallas, Texas

● Exception: Small claims court actions under $10,000 may proceed in appropriate venue

● Injunctive relief available in courts for intellectual property violations

Alternative Dispute Resolution:

Federal Compliance:

● All transactions must comply with Gun Control Act, Brady Act, and ATF regulations

● ITAR (International Traffic in Arms Regulations) compliance for any international aspects

● Bank Secrecy Act and anti-money laundering requirements

● OFAC sanctions and prohibited persons screening

State and Local Compliance:

● Individual state firearms laws and regulations

● Local municipality restrictions and ordinances

● Concealed carry permit recognition and reciprocity

● Assault weapon and high-capacity magazine restrictions

Ongoing Compliance Monitoring:

● Regular legal review of changing firearms regulations

● Automated system updates to reflect new legal requirements

● User notification of compliance changes affecting their transactions

● Platform modification or service suspension in jurisdictions where operations become legally problematic

If any provision deemed invalid, remainder of Terms remain enforceable.

● Compliance Responsibility: You accept full personal responsibility for compliance with all applicable federal, state, and local laws

● Identity Verification: You consent to comprehensive identity verification through third-party KYC providers and ongoing monitoring

● Payment Processing: You understand payments are processed through third-party processors (Fortis) with comprehensive fraud detection

● No Guarantees: You acknowledge the platform provides no guarantees regarding transaction completion, dealer performance, or legal outcomes

STRAW PURCHASES: Purchasing a firearm for another person who cannot legally purchase or possess firearms is a FEDERAL FELONY punishable by up to 10 years in prison and $250,000 in fines under 18 U.S.C. § 922(a)(6).

FALSE STATEMENTS: Making false statements on federal forms or during background checks is a separate felony under 18 U.S.C. § 922(a)(6) punishable by up to 5 years in prison and $250,000 in fines.

PROHIBITED PERSONS: Attempting to purchase firearms while being a prohibited person under 18 U.S.C. § 922(g) is a federal felony punishable by up to 10 years in prison.

ACTIVE MONITORING: GunStreamer employs sophisticated monitoring systems to detect violations and actively reports suspected criminal activity to federal authorities including ATF and FBI.

● Technology Service: You understand this is a technology platform, not a firearms dealer or broker

● Third-Party Content: You acknowledge all auction listings, livestreams, and product information constitute third-party content created by dealers and hosts

● Automated Systems: You consent to automated compliance monitoring, fraud detection, and risk assessment systems

● Data Sharing: You authorize sharing of information with law enforcement, regulatory agencies, and compliance partners as required by law

● International Compliance: You acknowledge ITAR restrictions may apply to any international aspects of transactions

VIOLATION OF FEDERAL FIREARMS LAWS CAN RESULT IN DECADES OF IMPRISONMENT AND MASSIVE FINANCIAL PENALTIES. ENSURE YOU UNDERSTAND AND COMPLY WITH ALL APPLICABLE LAWS BEFORE USING THIS PLATFORM. WHEN IN DOUBT, CONSULT WITH A QUALIFIED ATTORNEY SPECIALIZING IN FIREARMS LAW.
