Thinking of building a Ghost gun? I have been waiting to see what would happen when someone was picked up for building one. Below are the charges so far. Full law explained in the bottom.



* Each charged with first-degree criminal possession of a weapon, second-degree criminal possession of a weapon, 12 counts of third-degree criminal possession of a weapon, manufacture of a machine gun, third-degree criminal sale of a firearm, second-degree criminal possession of a controlled substance, third-degree criminal possession of a controlled substance, second-degree conspiracy and first-degree reckless endangerment.

Each were charged with a 13th counts of third-degree criminal possession of a weapon.

FACTS:

Are people allowed to make their own firearms?
Yes. Federal law allows a private individual to make a firearm for personal use, unless that individual is otherwise prohibited from possessing firearms.

Are "80%" or "unfinished" guns legal?
Unfinished guns that do not meet the definition of a "firearm" are not subject to regulation under the GCA. The ATF has long held that items such as receiver blanks, "castings" or "machined bodies" in which the fire-control cavity area is completely solid and un-machined have not reached the "stage of manufacture" which would result in the classification of a firearm per the GCA.

Do I have to register a self-made gun and do I need a permit to own it?
Federal law allows someone to make a firearm for personal use and does not require them to register the weapon or have a gun permit. But New York laws require anyone in possession of certain firearms, especially handguns, to obtain a permit and to register the gun.
