The transfer of the 4473 is if the business sells/ transfer to another FFL. If an FFL goes out of business with no successor/ buyer the ATF gets those by default. So if Walmart sold their firearm department to say Bud's Gun Shop, Bud's would inherit the 4473s. Since no one is acquiring that portion of the business the ATF is within their rights/ responsibilities per the law. The ATF is not violating the law, however the whole 4473 thing is an infringement in itself.
